3. Customer Obligations and Warranties
By using our Services, you warrant and agree that:
- Accurate Information: You will provide complete, accurate, and detailed information regarding the Shipment, including but not limited to description of goods, value, weight, dimensions, and country of origin.
- Proper Packaging & Labeling: You are responsible for packaging, marking, and labeling the Shipment in a manner adequate to withstand the ordinary risks of transport and in compliance with all applicable laws.
- Prohibited Items: You will not tender any illegal or prohibited items, including but not limited to hazardous materials, weapons, narcotics, counterfeit goods, or items whose import/export is restricted, without first obtaining a written agreement from Moetro Pacifics and providing all necessary documentation.
- Compliance with Laws: You are responsible for ensuring that the Shipment, and its import/export, complies with all applicable international, national, state, and local laws and regulations.
- Customs Power of Attorney: You grant Moetro Pacifics a limited power of attorney to act as your agent for customs purposes, including signing documents on your behalf to facilitate customs clearance.
4. Customs Brokerage Specific Terms
- Information is Critical: Our ability to provide efficient customs brokerage is entirely dependent on the accuracy and timeliness of the information you provide. Moetro Pacifics is not liable for delays, fines, or seizures resulting from incorrect, incomplete, or late information from the Customer.
- Duties and Taxes: We will advance payment of duties and taxes on your behalf as your agent. You are ultimately responsible for all duties, taxes, levies, and other charges imposed by any governmental authority. You agree to reimburse Moetro Pacifics for all such payments immediately upon request.
- Classification and Valuation: Any advice given by Moetro Pacifics regarding tariff classification, valuation, or other customs matters is for informational purposes only. The final responsibility for correct classification and valuation rests solely with the Customer.
5. Liability and Limitations
- General Liability: Our liability for loss or damage to your Shipment is limited by various international conventions and national laws (e.g., Hague-Visby Rules, Warsaw Convention, etc.) and our specific contracts.
